Terms and conditions of sale

These general terms and conditions of sale are those of SARL Aéronefs & Aérostats de Provence, located at 2209 Route de Valensole, Puimoisson (04410), with capital of €2,000, registered with the Manosque Trade and Companies Register under number RCS 478 694 680, intra-community VAT number: FR22 478 694 680.

Aéronefs & Aérostats de Provence holds a commercial operating licence issued by the DGAC (French Civil Aviation Authority) under the reference number: FR.DEC.390

Aéronefs & Aérostats de Provence holds an air carrier operating licence allowing it to provide public passenger air transport services exclusively by means of free balloons.

Aéronefs & Aérostats de Provence reserves the right to modify these general terms and conditions of sale at any time and at its sole discretion. The general terms and conditions in force are those displayed on the website at the time the purchaser places an order. By placing an order, the purchaser irrevocably accepts these terms and conditions, which the purchaser acknowledges having read prior to placing their order. By accepting these terms and conditions of sale, the purchaser guarantees that they are of legal age and have full legal capacity to place an order on the website.

Purpose

The purpose of these general terms and conditions of sale is to define the terms and conditions of sale to the purchaser, as well as the obligations of both parties. These conditions are contracted by the purchaser, but the ticket may be given to someone else as a gift, provided that the company is informed. The company then considers that the ticket holder accepts these general terms and conditions of sale.

Prices

Prices are valid and subject to change at any time without notice. These prices include 10% VAT, air transport liability insurance and flight organisation. They do not include accommodation, meals or transport to the meeting point.

Purchase of tickets

A ticket is valid for 24 months. Payment is made at the time of booking, either by credit card on the website www.aero-provence.com, or by cheque made payable to Aéronefs & Aérostats de Provence, 2209 Route de Valensole, 04410 Puimoisson. Payment by cheque is cashed upon receipt. Following purchase, the customer contacts us by telephone to set a flight date, subject to availability. All tickets are non-refundable and non-exchangeable. However, they are transferable to other people during their period of validity and must be handed over to the pilot on the day of the flight. Cancellation insurance is available for customers who are unable to reschedule their flight if it is postponed due to unfavourable weather conditions. In this case, the full price of the tickets will be refunded, less the cost of the insurance. The customer is informed that, in accordance with Article L132-2 of the Monetary and Financial Code, the order or commitment to pay, given by means of a payment card, is irrevocable. Payment may only be opposed in the event of loss, theft or fraudulent use of the card or data related to its use, or in the event of receivership or liquidation of the beneficiary.If it is impossible to use the ticket within 24 months, a written refund request must be made, stating that the ticket cannot be used by anyone else and indicating the ticket number. The purchase price of the ticket(s) will then be refunded, minus an administrative fee of €50 (including VAT) per ticket.

The ticket includes:

Transfer with our vehicles to the take-off site; preparation and inflation of the balloon; safety briefing; hot air balloon flight lasting between one hour and one hour and a half; packing away of the balloon; country-style buffet of fresh, local produce; return to your vehicles.

Flight conditions

Flights take place all year round. Passengers accept the specific constraints associated with organising a hot air balloon flight. Pregnant women cannot board and we ask you to inform us if you have any prostheses (hips, knees) or any other physical condition. The pilot may decide to refuse boarding if he considers that your physical condition does not allow you to fly safely.

Flight confirmation

Each appointment is confirmed the day before the flight from 1 p.m. by text message and email, specifying the exact time and location. Any passenger wishing to postpone the date of the flight must notify the company at least 72 hours in advance. If this deadline is not met, the passenger forfeits their ticket and is not eligible for a refund. On the day of the appointment, any passenger arriving late forfeits their ticket and is not eligible for a refund.

Cancellation by Aéronefs & Aérostats de Provence

The company reserves the right to cancel a flight due to bad weather conditions, safety conditions or if there are not enough passengers. Only the pilot is able to assess the suitability of a flight. This cancellation may take place at the take-off site; in this case, Aéronefs & Aérostats de Provence shall not be held liable for any costs incurred by customers in travelling to the meeting point (accommodation, meals and transport).

Modification of the service

The company Aéronefs & Aérostats de Provence may, for any reason related to safety or the flight’s operation, change the takeoff location or the hot air balloon.

Onboard Regulations

All passengers must be listed on the boarding manifest. The pilot of Aéronefs & Aérostats de Provence is the sole master of the aircraft and, as such, has authority over all persons on board. The pilot may, at any time, disembark any passenger or remove any cargo that may pose a danger to the flight. The pilot may also interrupt the flight at any time for safety reasons. No refunds will be issued for flights lasting at least 45 minutes.

Insurance

Passengers are insured according to the applicable air travel regulations (Montreal Convention). Aéronefs & Aérostats de Provence is covered by liability insurance for both passengers and occupants. The company Aéronefs & Aérostats de Provence cannot be held liable for any personal belongings carried on board (by passengers), which remain the responsibility of their owner.

Justice conciliator

Assignment of competence
